Objective
This Website Usage Policy (hereinafter referred to as "Policy") details the terms and conditions set forth to users (hereinafter referred to as "Members") by WORLD CYBER GAMES, Inc (hereinafter referred to as "WCG") for registration and usage of the Web Services (hereinafter referred to as "Services") offered by WCG.
Usage Policy Effectuation and Amendment
- This policy is effectuated via this online notice on the official WCG global website, www.wcg.com (hereinafter referred to as "WCG Website"), and is subject to amendment at any time it may be necessitated within the scope of the law. Any such amendments will be effectuated via online notifications, and any modifications of member rights, duties, etc. will be previously announced.
- Due to measures within reason that may arise at any time, WCG reserves the right to amend this policy within its discretion, but all such amendments will be announced via the WCG Website.
- Members agreeing to this policy agree to visit the WCG Website periodically to check for any policy amendments. WCG shall be in no way responsible for any damages or adverse effects incurred by any members due to unawareness of any policy amendments.
- After any policy amendment, if a member does not agree with the amendment, he/she is free to request termination of membership. If no such membership termination request is registered after seven (7) days of any policy amendment, a member will be regarded as having agreed to the policy amendment.
Definitions
The following are definitions of terms used in this policy statement.
- "Users" means members who use WCG Website membership services.
- '"Usage Agreement" means the agreement formed between members and WCG with regard to usage of WCG Website membership services.
- "Member Number (ID)" is the combination of letters and numbers selected by each member with the designation tag assigned by WCG to serve as identification.
- "Password" is the combination of letters and numbers selected by each member to serve as a measure to confirm and protect the identity and interests of each member.
- "Device" means the computer, modem, etc. system used to install membership applications and facilitate the usage of WCG Website membership services offered by WCG.
- "Termination" means the termination of the membership agreement between WCG and a member performed by either party.
Usage Agreement Establishment
- The Usage Agreement is established after a user agrees with this policy statement and registers for membership that is subsequently approved by WCG.
- Clicking the "Agree" button on the policy statement webpage when registering to use the WCG Website membership services expresses agreement with this policy statement.
Membership Types
- Full Membership: Full members (hereinafter referred to as "Members") are users who provide full identification information to use the WCG Website services.
- Associate Membership: Associate members are users who do not provide full identification information and prefer to use a limited range of WCG Website services that do not require identity authentication. Services not included in associate membership are clarified on the WCG Website.
- When the distinction between full membership and associate membership is not necessary, all members will be referred to as "Members" in this policy statement.
Application for Service Usage
- The conditions included in application for full membership are as follows.
- To use full services as a full member, a user must provide full identification information.
- To become a full member, a user must provide his/her true name and valid e-mail address. If either item is not authentic, then the user will not incur full usage rights.
- Any dishonest representation such as use of any name or e-mail other than a user's own will result in deletion of membership, and can be subject to prosecution to the full extent of the law.
- The conditions included in application for associate membership are as follows.
To become an associate member (possessing a simple ID), a user must provide the minimum required information such as ID, password, gender, etc.
- WCG reserves the right to monitor usage patterns and differentiate service characteristics based on usage time, usage frequency, service menus, service quality, etc. according to membership types.
Member Information Protection and Usage
- WCG pledges to perform best efforts to protect the personal information provided by members in their usage registration within the full bound of the law. Such protection is subject to related law and WCG's privacy policy.
- WCG's privacy policy does not extend to the websites that are linked to the WCG Website.
- WCG reserves the right to release personal information if requested to government and/or public/civil service agencies or organizations.
- WCG is not responsible for any release of personal information resulting from actions, voluntary or involuntary, of members themselves.
Usage Application Acceptance and Rejection
As a general rule, WCG shall accept all usage applications when no restrictive issues regarding service and technical processes occur.
- WCG can reject usage applications in the following cases.
- When users apply with an assumed name or any name that is not his/her own
- When false information is provided in the usage application
- When usage application is done to disrupt social order and/or morals and public well-being
- When usage intent is based on dishonest and/or illegal purposes
- When usage intent is based on commercial profit-making purposes
- When other rules and regulations are violated
- WCG can withhold acceptance of usage applications until issues such as the following are resolved.
- If WCG systems reach over capacity
- f WCG systems incur technical difficulties
- If other restrictive issues arise from WCG systems operations
- WCG reserves the right to defer acceptance of usage applications from minors, as defined by law, based on rules set forth in the information per service. In addition, any users fourteen (14) years of age and under must provide authorization from legal guardians for acceptance to be considered.
Member ID Assignment and Modification
- WCG shall assign each member with an ID as detailed in this policy statement.
- Any modification of an ID is not permitted, but if such modification is absolutely necessitated, a user must first terminate usage of his/her ID and then re-apply for usage.
- WCG can request that a user modifies his/her ID if issues such as the following arise.
- If a member's ID includes personal information, such as telephone number and social registration number, that can result in privacy infringement
- If a member's ID has the potential to offend others and/or runs counter to the generally accepted code of morals
- If an issue arises that reasonably warrants ID modification
- A member shall assume full responsibility for management and maintenance of his/her ID and password. WCG is wholly not responsible for any member neglect of such management and maintenance and any subsequent negative effect on service usage and/or usage of said member's ID and password by another person. In addition, if a member discovers any illegal usage of his/her ID and password, he/she is responsible for notifying WCG immediately.
- Other conditions related to personal information maintenance and modification are contingent on the information per service.
Membership Agreement Duties - WCG Duties
- WCG shall open services to members on the date requested by said members barring any unforeseen circumstances.
- WCG shall perform best efforts to ensure that service is consistent and stable, including prompt repair and restoration of service after any unavoidable service stoppages. WCG is not responsible for any such service stoppages.
- WCG has constructed a personal information security protection system and shall release and abide by the privacy policy.
- WCG shall accept all member opinions, feedback, and complaints, and if any issue is deemed valid within reason, WCG shall take appropriate action henceforth. If immediate action is not possible, the member shall be informed of such circumstances.
- WCG is not under duty to censor any services. However, WCG reserves the right to inspect any content and/or posting and make deletions under its sole discretion. WCG reserves the right to discontinue any and/or all services without prior notice to any member who violates the "Member Duties" stated herein.
- WCG reserves the right to release any information for legal purposes and/or fulfillment of any governmental requests when deemed appropriate under its sole discretion. WCG reserves the right to modify and/or delete any and/or all information items and/or postings under its sole discretion.
Membership Agreement Duties - Member Duties
- Full members must provide true information at the time of registration and/or personal information modification, and shall lose all usage rights if false information and/or information that is not one's own is submitted.
- Members must abide by this policy statement and any rules and regulations and/or announcements set forth by WCG and related law. Thus, any actions resulting in adverse effects to the operations and/or reputation of WCG are strictly prohibited.
- Members must follow appropriate procedures and notify WCG immediately of any modifications to any information included in the membership agreement including mailing address, telephone number, e-mail address, etc.
- All responsibility for maintenance and prevention of any neglect or unauthorized usage by another person of a member's ID and password not included in the scope of related law and the privacy policy is assumed by said member.
- WCG is not responsible for any results from any unauthorized service usage and related business activities. In addition, if any such business activities result in damages to WCG, WCG reserves the right to take legal action and collect compensation.
- Members cannot assign, transfer, and/or lend any service usage rights and/or membership agreement to any other party without the express written consent of WCG.
- Members must not infringe on any intellectual property rights of WCG and/or any third party.
- In relation to the following issues, members are strictly prohibited from the following actions. If any member performs any such action, WCG reserves the right to stop service, terminate the membership agreement, delete the member ID, and report said member to the proper authorities for sanctions.
- Provision of false information at time of membership application and/or modification
- Unauthorized use of another person's ID and password
- Usage of member ID for any commercial purposes with others
- Any misrepresentation/libelous action concerning WCG's operators, employees, partners, and/or contracting parties
- Any modification of client programs, hacking of WCG servers, and/or modification of any and/or all website content without express permission from WCG
- Abuse of any bugs in WCG programs
- Any activity that serves to disable service and/or any intentional disruption of service operations
- Any copying, publishing, broadcasting, distribution or use of information and/or content sourced from the services to any third party without the express written consent of WCG
- Any circulation of immoral, vulgar, and/or lewd contents including information, script, images, sounds, videos/animations, etc. using any means
- Upload of any viruses and/or virus-infected file/data
- Upload of any software and/or files/data that are protected under intellectual property law
- Publication, insertion, posting, and/or sending of any erroneous, non-permitted content such as advertisements/promotions, junk or spam mail, chain letters, and/or any pyramid schemes
- Any behavior and/or content that serves to offend, harass, threaten, and/or cause distress to others
- Any activity of a betting nature and/or commercial exchange
- Any extraction, collection, downloading of personal information of other members without express consent from WCG
- Any activity reasonably regarded as unlawful
- Any violation of this policy statement and any other rules and regulations set forth by WCG
- Any violation of related law
Service Usage Time
- Barring any unforeseen service stoppages due to internal or technical issues, service shall operate at all times, twenty-four hours a day, year-round. However, service stoppages can occur without prior notice due to emergency system inspection, expansion, replacement, etc. WCG reserves the right to perform such service stoppages under its sole discretion.
- If service stoppages are necessitated due to any state of national emergency, blackouts, system disruptions, and/or usage congestion, all and/or a portion of services may be temporarily discontinued. In such instances, members will be informed of the cause and duration prior to the service stoppage.
- WCG reserves the right to discontinue certain portions of service at any time. Members shall be notified prior to such action.
Member ID Management
WCG reserves the right to delete, move, and/or reject any notice/posting without notice if any of the following cases apply.
- Any serious insults and/or slanderous remarks are made to other members and/or third parties
- Any circulation of and/or link to immoral and/or anti-social content
- Any content that is of a commercial nature, such as sale or exchange of member IDs and/or cyber goods
- Any content that promotes illegal activities, such as software copying and/or hacking
- Any content and/or advertisements aimed at making a financial gain
- Any content reasonably deemed unlawful and/or criminal
- Any content that infringes on property rights and/or other rights of other members and/or third parties
- Any content that does not coincide with WCG rules and regulations
- Any content that may disrupt normal WCG and/or service operations
- Any content deemed to violate related law
Rights to Notices/Postings
- Members are strictly prohibited from altering, selling, and/or using for any commercial purpose any information sourced from the use of services.
- WCG reserves the right to delete, move, and/or reject any notice/posting without notice if any of the cases listed in the "Notice/Posting Management" section apply.
- WCG shall reserve all rights to any WCG Website content (both from members and WCG) during any official tournament period. Members are strictly prohibited from copying, distribution, and/or any use of a commercial purpose of such content without the prior express written consent of WCG.
Links
WCG and/or third parties can post links to other websites and/or files. WCG does not hold the right to control such links, and is thus not responsible for any website, content, advertisement, and/or product links that fall outside the bounds of any distinct cases of WCG intent or negligence.
Information Offering
- WCG can provide information deemed necessary to members via e-mail or in letter form.
- WCG can request additional personal information from members with member consent for any service improvements and/or member-targeted service introductions.
Advertisement Publication and Advertiser Relations
- WCG sources a portion of funding for service offerings from advertisers. Members shall consent to the exposure of such advertisements when using the services.
- WCG assumes no responsibility for any damages and/or losses from any transactions and/or interaction made between members and any advertising organizations that execute advertisements and/or promotions via WCG Website services.
Pay Services
- By general rule, usage of WCG Website services is free. However, WCG reserves the right to provide certain service offerings for a fee, and usage of these pay services shall be governed by a separate usage policy.
- WCG holds the property rights to any service usage related items and avatar items, and purchasing members hold the rights of usage. In following, such members hold the rights of usage of such items during a set period on the WCG Website, and any transfer and/or sale of such items outside the scope of permission is prohibited.
- To prevent abuse, WCG does not offer any refund to members for items that have been received as gifts from others and/or items received for free.
- The standard usage period for game items is one (1) year, after which usage rights are discontinued. If due to any change in game service and/or game service item policy, a member loses previously purchased items while the usage period is still in effect, notification will be posted on the WCG Website for seven (7) days or longer, and the member shall be compensated with new items of equivalent value.
- The product life cycle of avatar items is limited to one (1) year after initial distribution, and after this period, such items can be lost and/or discontinued. If any item is lost, notification will be posted on the WCG Website for seven (7) days or longer, and the purchasing member shall be compensated with the corresponding avatar items.
Game, Service, Website Restructuring and Division
- In the interest of continuously improving service quality, WCG reserves the right to modify and/or delete any game-related services at any time. In each case, to prevent any adverse effects to members to the maximum level, previous notification shall be provided.
- WCG reserves the right to restructure and/or divide game-related websites. In such cases, WCG shall actively notify members, and members shall be able to receive services from such modified websites.
Membership Agreement Modification and Termination
- If an associate member wishes to upgrade to full membership, he/she must provide complete required information.
- If a member wishes to terminate membership, he/she must enter the Customer Support Center menu of the WCG Website and complete the termination process. For members using other pay services, termination shall follow separate guidelines set forth by WCG.
Basic Guidelines for Competition
- After a user completes membership registration, he/she can freely participate in competition-related services.
- Members must agree to refrain from the following actions when using competition-related services.
- Use of profanity and/or any unsportsmanlike behavior during competition
- Use of any cheats and/or cheat keys
- Intentional disconnection
- ID abuse
- Intentional misrepresentation of competition results, as result registration is a manual process
- Intentional behavior that can result in disruption of competition operations
- Members shall report the following during any WCG online preliminary and/or any competitive event.
- Report to operation staff of any occurrence of any actions listed in point two (2) above
- Report manually of accurate competition results for confirmation purposes
- Members acknowledge the following penalties for any intentional action corresponding with those listed in point two (2) above.
- Loss of membership and all service usage rights
- Opening of personal information such as name, ID, e-mail address, etc. within the scope of the law
- Loss of all rights to participate in the WCG and/or any competition event
- Cancellation and return of any prizes won from participation in the WCG and/or any competition event
Service Usage Restrictions
- WCG reserves the right to restrict service usage by any members who violate any conditions cited in "Member Duties" and/or commit any of the following actions.
- Use of any offensive and/or anti-social nickname
- Committing insults to other members and/or disrupting service usage
- Other actions that prevent normal service operations
- Any request for corrective measures by the Telecommunications Ethics Board and/or any related public/civil agency
- Non-usage of service for three (3) months or longer
- Use of separate programs resulting in abnormal game operations and processes
- Misrepresentation of competition results including win/loss
- Forced completion and/or intentional disconnection of matches during competition
- Any attempt to alter proprietary programs
- Use of any unauthorized, altered proprietary programs
- Forced usage of any services that are unauthorized and above the level of registered membership
- Unauthorized usage for commercial gain
- Use of any programs to misrepresent and/or alter competition results
- Other actions that prevent normal service operation
- WCG reserves the right to stop, reformat, and/or terminate the membership agreement of any delinquent members without prior notice according to the conditions stated in the service usage restrictions listed above.
Customer Support
While using the WCG Website services, if a member desires to file a complaint or report any occurrences that result in damages, he/she can file such reports at the Customer Support Center ( webmaster@icm2k.com). WCG will perform best efforts to remedy such reports in the shortest time possible.
Damage Compensation
WCG does not assume any responsibility for any damages that do not correlate with the privacy policy for the usage of free WCG Website services.
Limitations of Liability
- WCG is exempt from liability for any service stoppages caused by natural disasters, war, fire, civil commotion, Acts of God or Acts of Enemies of the State.
- WCG is exempt from liability for any damages that may be incurred due to stoppages and/or irregularities in electrical and/or telecommunications provider services.
- WCG is exempt from liability for any damages that may be incurred due to service stoppages necessitated by system repairs, replacement, inspection, etc.
- WCG is exempt from liability for any damages that may be incurred due to service problems of a member's own making.
- WCG is exempt from liability for any damages that may be incurred due to errors and/or operation problems of a member's own computer, and also due to any omissions in personal information and ID (e-mail address) submitted by a member.
- WCG is exempt from liability for any losses and/or failure to meet profit expectations incurred by any member.
- WCG is exempt from liability for any damages that may be incurred from any usage and/or downloading of files/data via the WCG Website services. In addition, WCG does not assume any responsibility for compensation for any mental and/or physical damages caused to a member by other members while using the WCG Website services.
- WCG does not assume any responsibility for the accuracy of any information, files, and/or data submitted by members.
- WCG is exempt from liability for any damages that may arise between members themselves and/or members and third parties.
- WCG is exempt from liability for any damages arising from usage of the free membership services.
Intellectual Property Rights Indication
All contents on the WCG Website are owned by WCG, and the following copyright indication must be made. "WORLD CYBER GAMES, Inc. All Rights Reserved." The registered trademark of the WCG is owned by WCG. All other trademarks are the property of their respective owners.
Any reference in this policy statement to a company, organization, product, person, and/or event is fictitious and are not meant to represent any real company, organization, product, person, and/or event.
WCG holds the intellectual property rights to any patents, patent applications, trademarks, copyrights, etc. regarding the WCG Website content and services. If not expressly stated, members do not have any rights to such intellectual property. Any rights not mentioned specifically in this policy statement are owned by WCG.
WCG holds all ownership rights to all content and developed software available for download via the WCG Website. Members wishing to use such software are subject to completing a usage rights agreement. If such an agreement is not finalized, installation and use of the software is not possible.
Arbitration Rights and Governing Law
- Any conditions and/or factors not stated in this policy statement are based on telecommunications industry law and related stipulations.
- Arbitration of any disputes arising from service usage shall be performed based in Seoul, Korea in accordance with the appropriate arbitration rules.
- The governing law is that of the Republic of Korea.
